Such a relief my lawyer was able to drop my dui down to a wet and reckless, bac was .13 got stopped in oc. Did a lot of reading that the Fullerton court is very strict even my own lawyer told me that but he did all he can and was able to lower it. Learned my lesson the hard way and will never go through this again.

Hello all. I was arrested for DUI on January 24th, 2026 and had my arraignment set for the 24th of April. However, after showing up to the courthouse I was informed that the charges have not been filed yet by the DA and was recommended to call periodically to check for any updates. My main question is regarding restricted driving privileges.

I did not file for a DMV hearing within 10 days of the incident, so the automatic hard suspension went through. I was told by the DMV that the suspension is effective until the end of June. If my case is still postponed by that date, is there any way to reinstate my license between then and when my arraignment is set? I feel like I'm in a weird limbo period and I'm extremely confused. The circumstances of my arrest were a bit strange (crashed, called the cops on myself, was not witnessed driving but admitted to it in the moment and did not refuse testing).

Can I install an IID into my vehicle, file for SR-22, and attend DUI school all before my arraignment? Sorry for rambling, but any help is appreciated. Thanks.

I know what Im about to say is bad but please dont bash me about it I just want to know if anybody has been in my position I caught a dui last year in December then I got another one April this year in between those two I got a publix intoxication I have court for it may 7 and I have court july 7 for the second and the july 28th for the 1 dui I honestly cant afford an attorney I joined a sober living after my second dui Im attending aa meetings Im also signing up for Iop it all happened here in riverside county

All I see online is that DMV hearings are rigged or lawyers do not make a difference. I am curious if this is actually true or just personal bias? Is this a situation where the most disgruntled voices are the loudest? I myself had a good outcome where the DMV set it aside because of the issues my lawyer found. I would hate to know I am one of the few lucky ones, but still thankful.

“I had a BAC of 0.08 and was driving on the wrong side of the road at about 35 mph. There was no accident and no one was injured. I take full responsibility and feel genuinely remorseful. This happened in Santa Clara. I’m trying to understand whether it’s worth hiring an attorney to see if the charge could be reduced to a wet reckless instead of a DUI, given the potential impact on my future.”

My bf recently got arrested for crashing into parked cars and driving under the influence. He got his first DUI like 2/3 years ago. His current charges that I’ve found online are

23152(a) Vc: Dui Alcohol (M), 23152(b) Vc: Dui Alcohol/0.08 Percent (M), 23154(a) Vc: Drive W/bac .01+ While On Prob

and a seperate case

20002(a): Hit And Run With Property Damage

He’s yet to see a judge since it’s only been two days. Any advice or likely outcome?

also for the hit and run, he doesn’t remember driving away?? he swears the cops came to arrest him by the crash site.

Question how true is that once you are on the road driving it would ask you to blow like randomly..
or car locks?

Which I don’t think is safe.. you know ?

Unfortunately I made a very stupid mistake (22F) and was arrested for a DUI. A cop was parked and witnessed me make a strange maneuver. I complied with everything. He told me what I blew but I was so distraught I don’t remember. I believe it was under 0.15. I am extremely lucky to have been working in an amazing career in education that I love so much. Part of my role does require driving and I can’t stop fearing that this is the end and I have ruined my life. I have a consultation with a lawyer and have already requested my DMV hearing. I am just so lost and scared and confused.

I recently accepted an offer for a remote social media/producer role with a large digital publisher. The role is fully remote and non-driving/corporate (social content, video, etc.). I’m now going through the background check process, and I’m a little anxious because I have a recent misdemeanor DUI conviction that will likely show up. The arrest was in late 2024, conviction was in March of 2025, and I’ve completed all fines/court obligations and plan to pursue expungement once eligible. This role has nothing to do with driving, operating vehicles, or anything safety-related, which makes me hopeful it won’t be an issue, but the recency is what makes me nervous. I also know background checks have been taking longer in CA, so I want to give my current employer 2 weeks notice, but I’m worried to do it prematurely if there’s a chance this may be an issue.

Has anyone here passed a background check for a non-driving corporate/media role with a similar record? Did it come up for review, and if so, how did you address it with HR/background check teams? Should I disclose to the recruiter since I’ve just submitted the background check or wait to see if they flag it?

Trying not to overthink it, but would appreciate hearing from anyone with similar experience. Thanks!

I was found not guilty of both my charges minor with .05 bca (beat it with tittle 17) and a speeding ticket (95 in 55). I’ve called the mandatory actions unit and I kept getting told different things such as talk to my local chp and ask for them to write a report. I was also told that there’s no way I could get it back since I’m 18. My lawyer told me that I can 100 get it back. PLEASE HELP ME

What is the process for getting a restricted license or breathalyzer after citation hearing

I’m pretty sure I’m gonna just plead no contest. .11 at the station is what I blew. I just wanna get the process over with. My suspension occurs 3 days after my hearing, on Memorial Day. Is there anything I can do to get ahead on the process as far as setting up an appointment with the dmv or anything or do I have to wait to be sentenced before doing anything.

In order to get my license back I need to complete this

•A $125 reissue fee must be paid to DMV 14904 and 14906 VC

•proof of financial responsibility as provided in 16430 VC

•you must maintain proof of financial responsibility for 3 years.

Question what’s 16430 ?

Cause it says: proof of financial responsibility may be met by a 35,000 cash deposit or 35,000 surety bond.

Can someone please explain this to me?

Those are the codes that are in the letter that means no DUI classes, right?

Hi everyone, I was sentence on September 2024 for my 4th DUI and got house arrest (3 months) and on probation for 5 years. I've had a breathalyzer since 2024 November, and just finished Part 1 (12 months) of my DUI program. I was wondering if its possible to get an early removal of the Breathlyzer or if I have to have it for 3 years and finish the entire DUI program.

Missed my 21 day deadline, am I in big trouble?

Hey, I recently worked my DUI case down to a wet reckless and had to enroll in a 3 month DUI class by tomorrow. Luckily I got my booking done in time. However, I lost my housing the same day my plea/case was finalized and I’ve been struggling with homelessness and a loss of income cause I’m recently unemployed. So I lowkey forgot to enroll by the 21 day period. I plan on going to the court first thing in the morning to try and talk to the clerk and see if I can get a re-referral from the judge. Also, I didn’t get a referral the first time?! I’m not sure why, maybe a miscommunication on my part or my lawyer’s part. Anyway, just want to know how screwed I am?! I just got a job as of today and I also found housing that can be available to me on June 1st so I’ll be able to enroll and pay for it all and focus on attending classes, but I just want to know how badly this will impact my probation or my case and also if you think it’s likely for me to get an extension or re-referral tomorrow if I show up to court early?! I’m first time offender, DUI worked down to wet reckless

EDIT: update, it was fine. I walked in, told them it was my 21st day to enroll and that I hadn’t had time. They got me a new referral super quick, now I have an extra 21 days to enroll. Didn’t even have to see the judge! All is well.

First DUI

Received a DUI in January with a .22 BCA :( this was my first DUI and have had a clean record until now. I was arrested and kept over night approximately 16 hours. Lawyer withdrew from DMV hearing because he said there was a valid reason for the stop because I ran a stop sign in the camera footage.

I got an IID, SR-22 and started 9 month DUI classes. Im very stressed like everyone in this situation and do not want a DUI on my record mainly due to work purposes and license in healthcare. I’m not only dealing with the court but also have to submit documents to the board. I was told my DMV that i will have a second suspension if convicted but my lawyer did not tell me that... and it makes me upset. He wants to prepare a mitigation package. I started going to AA classes once a week and have been consistent, have character references, letter from my therapist as i suffer panic and anxiety disorders and had one at the time i was arrested, and resume. We haven’t gotten the evidence and discovery yet and I’m hoping the second suspension will overlap with the first DMV suspension…

My question is what are the chances the charges will be dropped down to a wet and reckless given my BCA of .22 and no previous record. The court date is in 2 weeks and idk what to expect, and it’s giving me a lot of anxiety as I am worried about my work license as well. Is there anything else let i should be doing to help my case. Any advice is really appreciated.

I got my dui back in March 2025. Blew a .11, no accident. First and only dui. Worried sick for over a year, just had my final court date a few days ago.

The DMV suspension was hard. That came soon after the dui, however if you blow over a .08 those are hard to win so I just took the punishment. I never hired a lawyer, so I just did the dmv call myself. Installed an IID but never enrolled in the classes, so I paid for the IID for nothing. I recommend against the IIDs because all of those companies are honestly just money hungry and will scam if they can.
A year goes by, dmv suspension was long over, I’ve had my license reinstated for some months. Time to go to court, the DA finally picked up the case.
Arraignment was fast, the second court date, or the pre trial, is where you spend some time and possibly conclude your case, which is what happened to me.
Never saw the inside of the courtroom for the pretrial. I got my public defender, and discussed what deal the DA already gave him. It didn’t make sense to me from the research I did, as he said the offer was a “DUI terminal.”
Sent me away so he could talk to the DA about a wet reckless, which is what I wanted. About 1.5 hours later he comes back and said they went for the wet, and the other deal was a mistake, because they mistakenly thought I had a previous DUI.
I write all of this to let you know there is hope. I asked lawyers, google, ChatGpt, what are my odds of wet reckless vs dui. Some said get a lawyer. Some said Public defenders are just as good. Id agree with that. Get a lawyer if you can afford it. But a public defender will take care of you. Express to them you want the best possible outcome, but don’t press them. Let them do their job.
Whether your case facts seem better or worse than mine, just trust your lawyers and do your best to present yourself well. I wish everyone reading this luck with their cases, and the lawyers who all responded to me before, thank you.
Let’s all try not to get another dui.
