Settled privately but other side later went through insurance

I got into a minor rear ender last week. We agreed to pay the invoice for the damage to the other car and signed an agreement and release confirming it was a full and final settlement in satisfaction of all claims. The agreement also co fimed the other side would not start a claim through insurance.

Surprise surprise - they still went ahead and did it despite the payment and the signed agreement. My insurance claims advisor contacted me and I told them the whole story and they said they would look into it.

Has anyone ever been in a similar situation? If so, how did your insurance company handle it in the face of a signed and witnessed agreement and proof of payment? I figure my insurance company would show everything to the insurance adjuster on the other side and they would tell them that it's settled privately and deny coverage because they'd rather not pay out anything either.

Any advice and insight would be greatly appreciated!

IM STRESSED! Insurance trying to deny my claim what do I do

Hi everyone, I’m looking for advice because I’m really stressed and not sure what to expect here.

A few weeks ago I was in a minor accident (literally a parking lot fender bender, about $3,300 in damage) while driving my mom’s car. She owns the car and has the insurance policy. I had permission to use it, but I was not listed as a driver at the time.

Context: • I’m her daughter and part of the household • I only use the car occasionally (a couple times a month at most) • I split my time between my mom’s house and my boyfriend’s house (they’re about 10 minutes apart) • I’m only 26 and don’t own a home or a car , and I never fully “moved” my things from my mom’s to my boyfriend’s • After the accident, my mom added me to the policy (I now understand the timing looks bad) • I primarily stay at my boyfriends and borrow his car

Now the insurance company is questioning coverage and asking for proof that I wasn’t a resident at my mom’s house when the policy started (October 2025).

So far: • I provided two receipts showing my name and my boyfriend’s address (December 2024 and December 2025) • They then asked my mom for a lease to confirm I’m not listed (but she has a mortgage, not a lease, so that didn’t really help) • Now they’re asking for more documentation (like receipts/mail) from September–December 2025

The problem is I don’t really receive or keep mail—if I do, it’s usually junk and I throw it out. I don’t have much “official” documentation tied to either address.

I’m honestly confused because: • I had permission to drive the car • I don’t use it regularly • This is a small claim (~$3,300)

But they’re treating it like a huge issue and now I’m worried they’re going to deny it. I’m also in the middle of moving downstate with my boyfriend and don’t have the money to pay this out of pocket.

My questions: • Does this still fall under permissive use if I only drove the car occasionally? • How much does being part of the household matter vs. how often I actually drive? • Is it normal for them to push this hard for a relatively small claim? • What should I do next if I can’t provide more “proof of residency”?

I’m not trying to misrepresent anything—I just genuinely don’t have the type of documentation they’re asking for.

Any advice or similar experiences would really help.

Rear ended, can I file a diminishing value claim using carvana as source

I have a 2016 prius and was recently rear ended. The damage wasn't too bad and the total bill came up to ~$3000 paid by the other partys insurance and the repairs look good, just bumper replacement and new paint.

Even before this accident I've been thinking of trading it for a new car and in carvana I now have to update to say 1 accident and doing this reduced by payout amount by $1,800.

The car looks completely fine, is a carvana with 1 accident vs no accident sufficient document for the other party's insurance company (State farm)

How to Handle A Citation Received At A Wreck?

If you receive a citation for failing to yield at the scene of an automobile accident how are you supposed to handle that?

  • It seems to me that receiving a citation shows that you are perceived to be at fault so paying the fine would be a bad move.
  • What phrasing would you use when explaining this to your insurance company?
  • Will the auto insurance company advise on what to do about the citation or is that a separate issue?
  • Does this require a lawyer?

Thank You

Getting compensated with rental car after someone hit my Audi q5

Hey guys, last Friday I was getting a haircut, and I parked my 2021 Audi q5 on the side of the road. Someone managed to crash into a parked car and their insurance (statefarm) has accepted 100% liability.

The problem is when I am asking to be covered with a rental car, they are pointing me to enterprise and only covering me for a standard suv (Hyundai Kona, Toyota rav 4). But there’s no way I’m driving that after someone hit my Audi which was just parked on the side of the road unoccupied.

Especially when an audi q5 when being rented out by enterprise themselves is $151 dollars a day in the premium elite suv class. They are compensating me with a $50 dollar a day car? No chance

My plan is to call the adjuster tomorrow and demand that “Under Colorado Regulation 3 CCR 702-5, Regulation 5-2-15, you are legally required to provide me a vehicle of comparable class to my 2021 Audi Q5 — a luxury SUV. Your internal rate limits do not override Colorado law. Failure to comply constitutes an unfair and deceptive act in the business of insurance and I will be filing a complaint with the Colorado Division of Insurance”

They are supposed to compensate me with a similar car despite whatever bs statefarm says correct???

Car insurance coverage as out of state student

TLDR: Florida resident attending medical school out of state in colorado, needs insurance policy to meet florida laws while "garaging" my car in colorado.

So for background, I am a Florida Resident with Florida drivers license and vehicle registration. I moved to Colorado in July of 2025 for medical school and am here as a full time student for at least 2 years (no job outside of school). My primary address is still in Florida where my parents live. The car title is in my name and my parents wanted me off their insurance (since they have more assets than me I guess, but I'm still on their health insurance)

When I first moved here I got car insurance through progressive in the state of colorado, 2 months go by and I get a notice from the Florida DMV that my license and vehicle registration will be suspended if I do not show proof of a florida car insurance policy. So I canceled my colorado policy and got a new policy with progressive back in florida with my primary address/ parents address. My car is still "garaged" in colorado.

Fast forward to this past weekend and I get rear ended on i-25. I submit the claim with my insurance (florida policy) and they ask what i was doing in colorado and I tell them im here for school. They then send me a request to update my address and show proof of address. I call to speak with progressive underwriting person because I wasn't sure which address they wanted. He basically says that since my car is garaged in colorado, my policy will not be renewed at the end of its term.

SOOO now I need to find new insurance. BUT I don't want to give up my florida residency and change my permanent address, license and registration, when I plan to go back to Florida when I am done with school. Florida requires me to have an in state insurance policy, but progressive insurance won't insure me while out of state at school in colorado. I don't know what to do.

Any recommendation on how to keep my florida residency but get coverage out of state? Should I go back on my parents plan (if they would even let me)? or are there other companies that would be able to do this? I really don't want to go through the hassle of changing all my documents over to CO (especially since I'm moving to a new house for the next year, and then potentially out of CO for my 3rd year rotations and then back to FL for 4th year of school.)
