Settled privately but other side later went through insurance
I got into a minor rear ender last week. We agreed to pay the invoice for the damage to the other car and signed an agreement and release confirming it was a full and final settlement in satisfaction of all claims. The agreement also co fimed the other side would not start a claim through insurance.
Surprise surprise - they still went ahead and did it despite the payment and the signed agreement. My insurance claims advisor contacted me and I told them the whole story and they said they would look into it.
Has anyone ever been in a similar situation? If so, how did your insurance company handle it in the face of a signed and witnessed agreement and proof of payment? I figure my insurance company would show everything to the insurance adjuster on the other side and they would tell them that it's settled privately and deny coverage because they'd rather not pay out anything either.
Any advice and insight would be greatly appreciated!
