DL.

What is the current timeline of future events?

When in June do we know what follows? Whatever the resolution, is it definitive or can they extend this process even longer?

When Could “Pending Litigation” End?

There are four possible scenarios — ranging from June all the way to 2027.

🔴 Scenario 1 — Ends in June (Worst Case)

The Supreme Court’s Haiti/Syria ruling is so broad that it wipes out all Venezuela claims too — procedural AND equal protection. The government then asks a lower court to formally dismiss the Venezuela case based on the new ruling. Litigation ends almost immediately. EADs and TPS protections cut off overnight.

🟠 Scenario 2 — Ends in October (Bad Case)

The June ruling kills procedural claims but leaves equal protection alive. The government has about 90 days from the Ninth Circuit’s denial of rehearing to petition the Supreme Court for review. If the Court grants cert on Venezuela in that window, the stay order specified that in the event certiorari is granted, the stay shall terminate upon the sending down of the judgment of the Court. That termination of the stay could coincide exactly with the October 2 deadline — leaving people in a legal vacuum.

🟡 Scenario 3 — Survives Past October (Middle Case)

The Supreme Court denies cert on Venezuela. The October 2025 stay order specified that if the petition for certiorari is denied, the stay shall terminate automatically — which would actually restore the Ninth Circuit’s pro-Venezuelan ruling. The case then goes back to lower courts with racial animus claims still alive. Litigation continues well into 2027.

🟢 Scenario 4 — Litigation Keeps Going (Best Case)

The June ruling is narrow — only blocking some procedural claims — and Venezuela’s racial animus argument survives strongly. The Venezuela lawsuit also contends the termination was driven by racial animus, violating the Fifth Amendment’s guarantee of equal protection. Lower courts continue fighting on that ground. Protections stay alive past October 2026 through new emergency orders.

The Simple Summary

|When it ends |Why |What happens to your EAD |

|-----------------|---------------------------------------|------------------------------------------|

|**June 2026** |Sweeping SCOTUS ruling kills all claims|Gone immediately 🔴 |

|**October 2026** |SCOTUS grants cert, stay terminates |Gone at same time as EAD expires 🟠 |

|**After October**|SCOTUS denies cert, fight continues |Ninth Circuit win restored 🟢 |

|**2027+** |Racial animus case drags on |New court orders could extend protection 🟡|

The cruel reality is that only Scenario 3 and 4 give Venezuelan TPS holders a real lifeline — and both depend on the government either losing or the Court staying out of it. Right now, that’s far from guaranteed.

🚨 ATTENTION TPS HOLDERS — You Need to Know This 🚨

If you have Temporary Protected Status (TPS) and applied for a work permit (EAD), here’s the reality nobody is talking about:

❌ USCIS has been sitting on TPS EAD applications since early 2025 — approving virtually none.

⏳ People have been waiting 10-12 months with NO work authorization. No income. No answers.

And now? New rules make it WORSE:

📋 The new H.R. 1 rules cap EAD validity at just 1 YEAR — or whatever time is left on your TPS designation, whichever is SHORTER.

Do the math:

→ You wait 10-12 months for approval

→ You receive an EAD valid for only 1-2 months

→ You apply again

→ You wait another 10-12 months

→ Repeat

USCIS will call this “normal processing time.”

But let’s call it what it is — a system designed to make life impossible without ever formally deporting anyone.

No court order. No removal proceedings. Just bureaucratic silence until people give up and leave.

This is happening to real people RIGHT NOW. People with valid legal status. People who followed every rule.

Share this. Tag someone who needs to know. And if this is happening to you — you are not alone.

Hi all. Looking for some advice/insight on my boyfriend’s situation. He came to America under TPS Venezuela 2023. Technically I believe the government ended TPS for Venezuela (redesignation of 2023) in the beginning of Feb 2025. His TPS expired April 2025. He applied to renew TPS and employee authorization (authorized for automatic extension) but he’s still waiting for government response (it says case closed?)

His license expires later this year- I had a thought that he could go report his license as lost to get a new one with hopes of a later expiration date for now. Thoughts? Thanks everyone for your help and insight. Definitely feel like we needed more people to talk about this with to have all the information and perspectives.

No era que el gobierno tenía 90 días para apelar la decisión? Ayer no se cumplieron los 90 días desde el 29 de Enero?

Ahora que?

I am trying to be neutral but the only two conservative justices that questioned the Solicitor General's reasoning were Justice Barrett and Chief Justice Roberts.

Solicitor General does have some strong points, with the most strongest one being the language of the statute barring judicial review. However, some of the case law he brought to the table doesn't really support his arguments, and he was called out for it multiple times.

The main issues are:

-Is the decision from the Secretary to terminate TPS subject to Judicial Review even when Congress enacted a statute barring judicial review.

-What is the meaning of the word "consultation." Does it require a response from the agency or person being consulted. What if you reach out to an agency to ask about country conditions but they never respond, is that "consultation"?

-The meaning of the word "Determination"

The two possible outcomes:

  1. Justice Barrett and Chief Justice Roberts join Justice Kagan, Justice Sotomayor and Justice Jackson: 5-4

Or

  1. The obvious party line split: 6-3.

One final note: I do believe the arguments for the Venezuelan TPS Designation are different from Haiti and Syria. The Venezuelan TPS has overlapping determinations weeks apart from each other: The extension before Biden left office and the termination weeks after Trump took office.

No estoy clara si los EADs igual siguen activos (las extensiones antes del 5feb) o automáticamente quedan nulas si efectivamente muere ya el TPS Venezuela en las cortes
