I’ve been digging into whether Amazon Flex drivers are actually independent contractors or if this is one of those gray areas where companies push the limits.
From a legal standpoint, it’s not about what Amazon calls us—it’s about how the work relationship actually functions.
Courts and the U.S. Department of Labor use what’s called an “economic reality” test under laws like the Fair Labor Standards Act. Basically, they look at the real working conditions to decide if someone is truly an independent contractor or actually an employee.
Here are the main factors they look at:
1. Degree of control
Does the company control how you do your job?
With Flex, Amazon:
Assigns routes
Sets delivery windows
Tracks performance
Can deactivate you
That starts to look less like “independent” and more like structured work.
2. Opportunity for profit or loss
Can you actually make business decisions to increase profit?
For Flex:
You can pick blocks, but you can’t negotiate pay
Expenses (gas, wear and tear) are on you
Not much real control over earnings beyond working more
3. Permanence of the relationship
Is this a one-off gig or ongoing work?
A lot of drivers do this regularly, sometimes full-time.
4. Skill and initiative
Does the work require independent business skill?
Driving and delivering isn’t exactly a specialized independent trade in this context.
5. Is the work central to the business?
This is a big one. Delivering packages is literally core to Amazon’s entire operation.
So what does that mean?
If enough of these factors lean toward “employee,” then legally, a company could be misclassifying workers.
That’s why gig work (not just Amazon Flex, but rideshare too) is constantly being challenged in courts and legislation.
Bottom line:
Amazon Flex being labeled as “independent contractor” doesn’t automatically make it true under the law. It depends on how these factors shake out in real life—and that’s still being debated.
