Österreich: bestrittene Claude-/Anthropic-Zahlungen via Stripe Link – ZaDiG, Chargeback, DSGVO?

Jurisdiktion: Österreich.

Ich poste bewusst anonym und suche keine verbindliche Rechtsberatung, sondern eine Einschätzung zu sinnvollen Eskalationswegen.

Bei mir wurden Mitte April über Anthropic / Claude mehrere von mir nicht autorisierte bzw. bestrittene Zahlungen ausgelöst. Es geht um drei „Gift Max 20X“-Käufe via Link / Stripe Link, insgesamt rund 650 EUR.

Ich habe diese Käufe nicht ausgelöst, nicht bestätigt und nicht autorisiert. Der Anbieter wurde mit Rechnungen und Zahlungsbelegen kontaktiert. Die Bearbeitung lief bisher überwiegend automatisiert; eine erkennbare menschliche Billing-/Security-Prüfung gab es bislang nicht.

Ich bereite aktuell Folgendes vor:

  • Bank-/Kreditkartenreklamation bzw. Chargeback
  • Verlangen eines Nachweises der Autorisierung / SCA / 3D Secure
  • Stripe-/Link-Beschwerde
  • DSGVO-Auskunft nach Art. 15 DSGVO beim Anbieter
  • ggf. AK / Internet Ombudsstelle / weitere Verbraucherstellen

Meine Fragen:

  1. Sollte ich gegenüber der Bank ausdrücklich auf §§ 66 und 67 ZaDiG 2018 verweisen, wenn ich die Autorisierung bestreite?
  2. Ist es sinnvoll, konkret den Nachweis der starken Kundenauthentifizierung / 3D Secure zu verlangen?
  3. Sollte die Bank/Kreditkartenstelle vorrangig zuständig sein, auch wenn die Zahlung über Stripe Link abgewickelt wurde?
  4. Kann ich über Art. 15 DSGVO sinnvoll Account-, Session-, Payment-Flow- und Gift-Redemption-Daten vom Anbieter verlangen?
  5. Wäre bei ausbleibender Reaktion eher AK, Internet Ombudsstelle, FMA oder Anzeige der nächste sinnvolle Schritt?

Ich poste keine Rechnungen, Receipts, Kontoauszüge oder personenbezogenen Daten öffentlich. Geschwärzte Belege und eine dokumentierte Zeitlinie existieren.

I am dealing with several disputed Anthropic / Claude charges processed via Stripe Link. In mid-April, three separate “Gift Max 20X” charges appeared, totalling about EUR 650.

I did not initiate, confirm, approve, or authorise these purchases. The merchant was contacted with invoices and receipts, but the case was initially routed mainly through automated support instead of a substantive human billing/security review.

I am already preparing the proper channels:

  • bank/card issuer dispute
  • request for proof of strong customer authentication / 3D Secure
  • Stripe Link complaint
  • GDPR Art. 15 data access request to the merchant
  • consumer protection escalation if needed

My questions are:

  • Under EU/Austrian payment rules, should the bank/card issuer provide proof of authentication if I dispute authorisation?
  • Is it reasonable to request SCA / 3D Secure evidence specifically?
  • Can I use GDPR Art. 15 to request account/session/payment-flow/gift-redemption data from the merchant?
  • Should I prioritise chargeback through the issuer over continuing with merchant support?
  • Are there Austrian consumer bodies that are particularly useful in such digital-payment cases?

I am not asking anyone to resolve the account issue here and I am not posting documents publicly. I am looking for practical legal escalation pointers.

From a card-dispute perspective, I am trying to understand the best escalation path:

  • Should this be filed as unauthorised card transactions?
  • Should I specifically request proof of SCA / 3D Secure authentication?
  • Should the issuer/card provider handle the dispute even if Stripe Link was involved?
  • Is chargeback appropriate if the merchant does not provide recipient/redemption/session data?
  • Should the card be replaced if a saved Link payment method may have been used?
