Retoure-Parcel within Germany
I could really use some advice because I honestly don’t know how to handle this situation right now.
I recently ordered an Apple Watch Ultra 2 just to try it out. Pretty quickly I realized that it’s too thick and bulky for me, and I don’t really need all those features. For over €500, it just wasn’t worth it to me, so I decided to switch to a cheaper model and return it.
I requested a return label from the seller Clevertronic, packed everything properly (including the watch and the band), and dropped the package off at DHL. I also took a photo of the drop-off receipt.
Two days later, I got a message from the seller saying the package arrived — but supposedly it only contained the band, and the watch was missing.
That honestly hit me pretty hard. I was just eating at that moment, and after reading that message I completely lost my appetite, especially since we’re talking about over €500.
I immediately went home and searched my entire apartment, but the watch is definitely not here. I’m 100% sure I packed it. My father was even there when I packed the package, because I had another return at the same time and did both together.
I also called DHL and asked about things like the shipping weight, but they couldn’t give me that information. The only thing I got was the name of the person who received the package at the seller’s location.
After that, I contacted the seller and asked them to start an investigation with DHL. Their response was that they couldn’t do that because, according to internal DHL photos, there were no signs that the package had been opened. They also said they would keep the box and that I should file a police report.
I did some research myself, and as far as I understand, with returns the liability shifts to the seller once I hand over the package. I packed everything properly and handed it in as required. If something happened along the way — whether at the drop-off point, within DHL, or anywhere else — that’s out of my control.
The only possible piece of evidence I might have is the shipping weight, but I haven’t been able to get any information about that. The seller also didn’t provide anything specific, just that the watch wasn’t in the package.
I’ve also read about cases where contents of packages get swapped during transit (for example replaced with stones or similar), but I have no idea if something like that happened here.
As recommended, I also filed a police report against an unknown person.
So now my questions are:
Has anyone experienced something like this before?
Can the police actually do anything in a case like this?
Is filing a report realistically helpful?
Is there any way to track the watch via Apple, like using a serial number or something similar?
Right now, I honestly feel pretty helpless because I don’t know how I’m supposed to prove that I actually packed the watch.

Ich brauche mal euren Rat, weil ich gerade echt nicht weiß, wie ich mit der Situation umgehen soll.

Ich habe mir eine Apple Watch Ultra 2 bestellt, einfach um sie mal auszutesten. Relativ schnell habe ich gemerkt, dass sie mir zu dick und zu klobig ist und ich die ganzen Features gar nicht wirklich brauche. Für über 500 € war mir das dann einfach zu teuer, deshalb wollte ich auf ein günstigeres Modell umsteigen und habe die Uhr zurückgeschickt.

Ich habe mir dafür ein Retourenlabel vom Händler Clevertronic geholt, alles ordentlich verpackt (inklusive Uhr und Armband) und das Paket bei DHL abgegeben. Ich habe auch ein Foto vom Einlieferungsbeleg gemacht.
Zwei Tage später kam dann die Nachricht vom Händler: Paket ist angekommen, aber es war angeblich nur das Armband drin – die Uhr fehlt.
Das hat mich ziemlich getroffen. Ich war in dem Moment gerade am Essen und hatte danach ehrlich gesagt erstmal keinen Appetit mehr.

Ich bin direkt nach Hause und habe meine komplette Wohnung durchsucht, aber die Uhr ist definitiv nicht hier. Ich bin mir zu 100 % sicher, dass ich sie eingepackt habe. Mein Vater war sogar dabei, als ich das Paket gepackt habe, weil ich noch eine zweite Retoure hatte und das direkt zusammen erledigt habe.

Ich habe dann parallel bei DHL angerufen und nachgefragt, unter anderem wegen dem Versandgewicht, aber dazu konnten die mir nichts sagen. Ich habe nur den Namen von der Person bekommen, die das Paket beim Händler entgegengenommen hat.
Danach habe ich dem Händler geschrieben und sie gebeten, eine Nachforschung bei DHL zu starten. Die Antwort war, dass sie das nicht machen können, weil laut internen Fotos von DHL keine Anzeichen dafür vorliegen, dass das Paket geöffnet wurde. Außerdem meinten sie, dass sie den Karton behalten und ich am besten eine Strafanzeige stellen soll.

Ich habe mich dann selbst etwas informiert und so wie ich es verstanden habe, liegt die Haftung bei Retouren ab dem Moment der Abgabe eigentlich beim Händler. Ich habe alles ordnungsgemäß verpackt und abgegeben. Wenn auf dem Weg – egal ob im Paketshop, bei DHL oder irgendwo dazwischen – etwas passiert ist, kann ich ja nichts dafür.
Mein einziges mögliches Argument wäre wahrscheinlich das Gewicht, aber dazu habe ich keine Infos bekommen. Vom Händler kam dazu auch nichts, außer dass die Uhr nicht im Paket war.
Ich habe auch gelesen, dass es wohl Fälle gibt, wo Inhalte aus Paketen unterwegs ersetzt werden (z. B. durch Steine oder ähnliches), aber keine Ahnung, ob das hier passiert ist.Ich habe dann auch, wie empfohlen, eine Strafanzeige gegen Unbekannt gestellt.

Jetzt meine Fragen:
Hat jemand schon mal so etwas erlebt?
Kann die Polizei in so einem Fall überhaupt etwas machen?
Bringt die Anzeige realistisch gesehen etwas?
Gibt es bei Apple irgendeine Möglichkeit, die Uhr über Seriennummer oder Ähnliches zu verfolgen?
Kann DHL noch irgendwie helfen???
Ich fühle mich gerade ehrlich gesagt ziemlich hilflos, weil ich nicht weiß, wie ich beweisen soll, dass ich die Uhr wirklich eingepackt habe.
Vom Händler kommt leider auch kaum Unterstützung. Sie sagen nur, dass sie Auskunft geben, wenn die Polizei sich meldet, aber eine Erstattung lehnen sie aktuell ab. Ich verstehe irgendwo auch deren Sicht, aber ehrlich gesagt hätte ich mir da trotzdem etwas mehr Entgegenkommen gewünscht.
Ist insgesamt einfach eine extrem unangenehme Situation.
