So I am really on the fence and not sure if this really is workers comp or if im just unlucky.

Backstory. In 2021 I injured myself with a really bad herniated disk that got to the point of surgery. That one was workers comp and was taken care of and settled under that company. I was cleared for work and if I remember right, was told I was now 30% disabled. Barely any back pain and I was fine after that.

Fast forward to October 2025, I start a new job that ends up being a lot of sitting. The chairs provided were A, not even slightly comfortable, just plastic chairs and B, were not made for someone 6'9". Being that i had back issues before I started in November 2025 applying through Broadspire to get a workplace accommodation for an ergonomic chair. Broadspire has continued to make getting a chair difficult to the point im still in April 2026 fighting them to get it approved.

Well to no surprise, the chair I had to sit in daily was putting a lot of pressure on my back and my back started hurting a lot. I saw a doctor in December and they said the chair was needed. Come January 2026 things got to the point I couldnt sit or stand and I now had a herniated disk that wasnt there before the job.

In my eyes, this injury was caused by my company not accommodating a pre existing disability to the point it made things a lot worse and injured me.

Is this an accurate outlook and worth getting a lawyer to fight or is this normal? Was already working with workers comp and they are a nightmare and denied the claim due to me saying I think it broke one time when at work I twisted in my chair and sneezed in a weird way, but they were forcing me to say an exact time it happened as opposed to it being over time. Might have shot myself in the foot there.

Any recommendations or advice is appreciated.
