I’m looking for some advice or experiences regarding a DMCA situation. I have a product in a common niche that I spent weeks designing from scratch. It recently became a "Best Seller" and started competing directly with a long-time seller in that niche.
This competitor just filed a DMCA takedown against me. However, there are a few red flags:
- The notice says the copyright is "Unregistered" and the only "proof" they provided was a Google Drive link with some images.
- According to eRank, this seller is based in India, but their Etsy shop location is set to the USA.
- Their shop isn’t very large (around $15k-$20k total revenue over 2 years), yet they are trying to gatekeep a generic concept that many others have made before.
I’ve already filed a formal counter-notice because I am 100% sure my work is original and not a copy of their files.
My question is: Given that they are likely international, have a low-revenue shop, and no official copyright registration, how likely is it that they will actually try to file a lawsuit in the next 10-14 days? Has anyone dealt with this kind of "bullying" from competitors once you hit Best Seller status?
I'm not looking for legal advice, just trying to see if this is a common scare tactic. Thanks!
