I’m looking for some advice or experiences regarding a DMCA situation. I have a product in a common niche that I spent weeks designing from scratch. It recently became a "Best Seller" and started competing directly with a long-time seller in that niche.

This competitor just filed a DMCA takedown against me. However, there are a few red flags:

  1. The notice says the copyright is "Unregistered" and the only "proof" they provided was a Google Drive link with some images.
  2. According to eRank, this seller is based in India, but their Etsy shop location is set to the USA.
  3. Their shop isn’t very large (around $15k-$20k total revenue over 2 years), yet they are trying to gatekeep a generic concept that many others have made before.

I’ve already filed a formal counter-notice because I am 100% sure my work is original and not a copy of their files.

My question is: Given that they are likely international, have a low-revenue shop, and no official copyright registration, how likely is it that they will actually try to file a lawsuit in the next 10-14 days? Has anyone dealt with this kind of "bullying" from competitors once you hit Best Seller status?

I'm not looking for legal advice, just trying to see if this is a common scare tactic. Thanks!

My sales dropped after I spoke with customer service?

Body: Hi everyone, I need some insight on a weird situation.

The Context: A while ago, one of my digital listings was removed due to an IP claim (classic competitor move, as the design was entirely my own original work). To stay safe, I deleted the listing immediately.

The "Mistake": I wanted to be a "good seller" and follow the rules, so I contacted Etsy Live Support. I asked them a very specific question: "I have a store on another platform (Gumroad) where I still host that removed item. If I add my general Gumroad link to my Etsy 'About' section, would that be a policy violation?"

Support’s Response: They basically gave me a formal warning, saying that promoting a storefront that hosts "flagged" content could lead to policy concerns and account risks. After hearing this, I did NOT add any links. I stayed away from it completely.

The Problem: Right after this chat, my sales literally fell off a cliff (see attached screenshot). I haven't changed my SEO, my prices, or my ads. It’s like my shop suddenly became invisible in search results.

My Question: Does Etsy "flag" or shadowban shops that ask "red-flag" questions to support? It feels like simply mentioning a removed item and an external link put me on a manual review/restricted list.

Has anyone experienced a sudden drop in traffic after a sensitive conversation with support? Or is this just a massive coincidence?

Under normal circumstances, I should have made at least $50–$60 in sales by now, but I’ve only made $9. Most of the orders usually came in while I was asleep, but when I woke up, I hadn’t received a single order.
