My sister agreed to fill out a form to drop DV charge against her husband (although it is still up to the state to decide), she still wants to work things out with her partner. However, what if it doesn't work out and she wants a divorce? Can she get full custody of her kids (in a state with 50/50 custody) even though his lawyer may possibly have the DV charge expunged? Should I advise her to get a lawyer or wait until she actually wants a divorce later?
