The 180 night cap for short term rentals in Toronto only applies for entire unit rentals. No night cap on partial unit rentals

I see a ton of confusion over this in the Greater Toronto Area. There's a 180 day short term rental limit for cities like Toronto, Mississauga, Etc. The reason being you're supposed to only rent out your primary residence

BUT what many don't know is that you can short term rent 365 days a year if it's a partial unit registration. There is No night cap because you can still live in a part of the home and rent out the rest

This only applies for renting out a part of the same dwelling. So if you live upstairs and try to rent out your basement that is a seperate dwelling, this would not work. But if you live upstairs in 1 room and partial rent out the other 3 rooms this would work.

Toronto 8.5% MAT drops back to 6% on August 1, 2026

Toronto's Municipal Accommodation Tax was bumped from 6% to 8.5% on June 1, 2025 to help fund FIFA World Cup 2026 infrastructure and security.

It's scheduled to revert to 6% on August 1, 2026, right after the tournament ends. That's a 2.5 percentage point cut on every booking, automatically applied by Airbnb.

For a host doing $50K a year in revenue, that's $1,250 effectively kept by the guest (better booking conversion at the same total price) instead of going to the city.

Actionable Tip: Adjust your pricing for late summer and fall pricing strategy accordingly

I manage short and mid term rentals so I speak to people who accidentally break the rules all the time before working with us. They try to rent out their basement on Airbnb and even get a short term rental license for their address. everything seems great UNTIL they get a call from the city to do an inspection

The inspector comes, determines their basement is a separate dwelling, cancels their license and airbnb cancels all their future bookings costing them thousands in fees and fines

Solution: learn the definition of a dwelling. If your basement is separate kitchen, bathroom, etc. it is likely considered a separate dwelling under city of Toronto bylaws

This means you can't rent out just your basement as an Airbnb unless the Basement (not the upstairs) is your primary residence. Or unless your basement is actually not a separate dwelling (usually the full kitchen is the biggest determining factor).

If you're in most cities in the Greater Toronto Area (Toronto, Etobicoke, Mississauga, North York, Scarborough, etc.) you're limited to 180 days of short term rental per year.

It's super important to track this because this is easily auditable by the city of Toronto and comes with fines

Just thought I'd share a quick tip on how to track this as easily as possible

If you have a PMS system (hospitable, guesty, etc.) they will have an API that you can then connect to Claude or your favourite AI tool

Then ask your preferred AI tool to create a spreadsheet and track the number of days you have left. Review this monthly, double check the work, and make sure you never go over the 180 day limit

Looked at data from 320+ Toronto listings. Hosts using flat rate pricing earn about $1,283 less per month than hosts using dynamic pricing.

background: this is based on 2-bedroom condos in Toronto

The biggest gap is seasonal. A flat rate host charges $150/night during Caribana weekend when they could charge $280. Then charges the same $150 in January when they should be at $95 to actually get booked. Lose on both ends.

Toronto has some of the most extreme seasonality in Canada. Caribana, TIFF, Pride, and now FIFA. If your pricing doesn't move with those events, you're basically subsidizing your guests' vacations.
