Hi Everyone! I’m in a weird situation, my car was crashed into and my insurance only provide 21 days of hire car. Unfortunately that ended 4 weeks ago and I still am yet to receive an update on whether they are fixing my car or writing it off (thanks Budget Direct!) I’ve had to look into other means of transportation, renting a car was far too costly and with no set amount of time it was hard to keep organising on a week by week basis.
I decided the next best course of action would be to purchase a little buzz box with rego and roadworthy that I could then sell at a slight loss.
I jumped on Auto Trader and found a 2012 Ford Fiesta with relatively low km for 4k including rego and a roadworthy, I called up the “dealership” (if you could call them that) and had a look at the car. Cosmetically it’s rough, it’s got a good service history but the back door didn’t shut for some reason, they said that it had to be fixed in order to get the roadworthy. I said okay it’s temporary and paid a $1k deposit.
That was last Tuesday on the 21/4/26 I told them that I needed a car ASAP because I was currently without and they said yep no worries. We’ll have it to you by the end of the week that never happened. They told me I would have it Monday that never happened now they are saying late this week.
I can’t really afford to wait around without a car. I asked the dealer if they would consider refunding me and selling the car to someone else and I would try to source a different car. The dealership straight up told me “no refunds It’s not something we do” I have a signed contract which states the car will be delivered with roadworthy and three months rego.
I was told today that the original mechanic that was doing the roadworthy has mysteriously gone on holiday and not told anyone and that the dealership are now looking for another mechanic to do the roadworthy throughout this. They’ve also moved their entire yard from Northcote to Clayton and said I have to pick the car up from there. I’m in Tullamarine…
The dealership have an LMCT my questions are number one. Can they say no refunds? Number two, is it a reasonable expectation that I pick the car up ages away from where I viewed it?
So far they have a $1000 deposit from me and no clear timeline on when I will receive the car. How do I go about getting my money back at this stage they’ve just keep telling me no.
To add some additional information the contract was written by hand on a piece of paper and states that the Ford fiesta is to be sold with roadworthy and three months rego there are no other terms and conditions listed.
