I’m a Spanish citizen currently residing in Italy (registered with the local municipality). My partner is Mexican. She previously held a residence card in Spain as the partner of an EU citizen, but it has now expired.
We have recently moved to Italy together, where we own a home, and we are trying to understand the correct legal path to regularize her status here.
We have explored two options so far:
Registering a convivenza di fatto (cohabitation), but the Comune told us she needs a valid residence permit first.
Applying through the Questura as a family member of an EU citizen, but we are not married.
My questions:
Has anyone successfully obtained a residence permit in Italy as an unmarried partner of an EU citizen?
Is a previous EU residence card (from Spain) helpful in practice?
Is convivenza di fatto ever accepted as a basis to apply for residence, or is marriage effectively required?
Any real experiences in Italy (especially recent ones) would be very helpful.
