Has anyone had experience with being at a new employer with an open case from a previous employer. I have an open case for a back injury from a previous employer, but was cleared to work with no restrictions unfortunately now I’m having a flareup. I’m at a new employer do I need to file a new workers comp claim with a new employer for the flareup? I’m afraid there’s going to be pushed back from both sides trying to put the blame on the other employer, very obviously this is a pre-existing condition. I do have a lawyer and I’m talking to my lawyer, but I’m questioning my lawyer’s competency at this time due to a mistake they made in the past

I had a disc herniated about a year ago. My original workers comp doctor was pressuring me to go back to work. I was willing to do so because I wanted to see if I could tolerate it and I realized I didn’t really have a choice when he was gonna release me back to work. My previous job was a Travel Nurse and they terminated my contract after my injury so I no longer was employed by them. I ended up having to get a new job. I worked for about two months on a temporary contract and recently got a per diem job unfortunately I’m having a flareup of my injury and I think I will have to go back on work restrictions and may even end up having to have permanent restrictions because I don’t think I can do this job long-term. I do have a lawyer but now my lawyer is telling me that if I’m put on restrictions that I will probably not get workers comp payments. I’m trying to figure out what to do. I was not aware of this in the first place because this would’ve impacted my decision to go back to work or not.
