Wife Filed False 498 A Case in Women's PS
My wife filed a false 498 A Case in women's police station in my city.
She left the house within 2 months of marriage and never returned. After so much of waiting, we filed for divorce and within few days they filed this false case on our family and included me, my parents and my sisters as well. After 3 counselling sessions (police never heard my version of the story), they filed FIR and all family had to go to PS to appear and take 41A notice. Police are saying there will be station formalities (bribe; from what I can sense as the guy is saying it in low voice) and asking for surety of 2 persons who has a property in their name along with surety certificate after 2 days of filing FIR. They are saying you have to bring surety otherwise we can arrest any one of you. And these 2 days we tried for surety, but no one is ready to put the house/property documents. Don't know what to do now.
Do they have right to arrest if I don't provide Surety.
Also, how much they would be expecting from me as a bribe? (asking general expectation, I know it depends on the person/station)
I don't want to give bribe as the facts of the case or on my side (checked with a lawyer) and also I am afraid that they will record while giving money/(payment transaction, if paid online) and file another corruption/bribe related case on me as the wife's side doesn't have any proofs as they claim. I still didn't get the compliant copy so literally don't know what she mentioned in the complaint.
After FIR filed, one police and his assistant came unannounced to my house (based on the address given by her in the compliant) and took a photo of mine. Because of this incident, I'm literally scared that they might arrest me/my old parents/sisters all of sudden or in the weekend to harass us.
Please advise me on Do's and Don'ts and requesting information regarding the above queries if you have any idea and how to proceed further with this kind of case and how much time it will take to cancel the FIR/case in PS with all the court proceedings involved.
