I’m considering buying a penthouse in Koramangala, Bangalore, and wanted some advice.

A builder is offering me this penthouse at around 4.5 CR, which seems like a good deal for the area. The catch is, this property was already sold a few years ago to another buyer. A partial payment was made back then, and a sale agreement was signed between the builder and that buyer.

However, things didn’t go through after that, either payments weren’t completed or weren’t accepted. Now there’s an ongoing court case where the original buyer is asking the builder to honor that agreement and complete the sale.

Meanwhile, the builder is offering the same penthouse to me. He says since the property was never registered in the previous buyer’s name, that deal is effectively void. He’s also suggesting doing the sale in a backdated manner to bypass the earlier agreement, and says he’ll take responsibility if any issues come up later.

I know the safest option is to walk away, but given the price and location, it’s very tempting.

What I want to understand is: how risky is this really, and is there any way to structure this deal so that I’m legally protected? What checks or safeguards should I put in place if I decide to go ahead? Intent is to take the deal somehow while safeguarding my interest.
