WC return to work w/restrictions question
I have an over use injury. Post tibial tendonitis w/ possible plantar fasciitis, 2 bone spurs shown on x-ray. The pain was sudden but progressively worsened over a couple months to the point I couldn’t walk without significant pain
I went off work after seeing my regular provider on a medical disability. I filled WC injury with in a month of my disability leave and the case was recently accepted. The WC doctor said I was not totally disabled and can perform desk duties so wrote letter stating such. I turned it into my employer but received no response.
My return to work from the medical disability was around 5 weeks after the that. I returned to work on the day the medical disability ended with an updated WC return to work with restrictions letter. My supervisor told me she didn’t think upper management would allow me to work if I can’t perform my regular duties.
Researching I found my employer should provide job offer within 60 days if they are able to accommodate my restrictions. Should I even be back at work without written acceptance of my restrictions? I’m going to look at attorney consultations tomorrow so I can learn what rights I have and if I should be not going into work without the job offer. I have only been back a couple weeks and between working again, aquatic therapy and regular PT my pain has returned and is increasing.
I am seeing doctor tomorrow and requesting reduction of hours/days due to the increased pain level. Any advice would be greatly appreciated thank you
