PA auto 50/50 Liability Payout?
My parked car was hit in a gym parking lot in Pennsylvania. I opened the driver’s door of my Lexus GX460 and the driver of a Toyota Corolla ran into my door. The damage to my vehicle was only to a small portion of the door, he will require a new front bumper.
My vehicle is paid off and I only carry liability coverage through USAA, the other driver has Progressive. My insurance found him 100% at fault and denied his claim. His insurance found that we were each 50% at fault and has actually been particularly confrontational.
They are telling me that I will need to have my vehicle repaired through their in network shop and only then will they pay for 50% of the repairs. Their shop has refused to schedule an evaluation of the damage until Progressive submits a request from their end.
I am unsure how to proceed. I would like to get an estimate, have them cut me a check, and then likely swap out the door myself. Any advice is greatly appreciated.
