Torn bicep & rotator cuff
Little background on my case I work in the medical field I tore my bicep & rotator cuff repositioning a resident back in sept of last year and got surgery the following month (October 13). I have had a rough estimate total of 16 physical therapy sessions throughout my 6 months out of surgery. Claims adjuster keeps denying my physical therapy even though their orthopedic specialist that performed the surgery keeps asking them for my P.T. As of last month roughly I’ve become very depressed and developing anxiety in the fear I may never get my active lifestyle I once had back.. I let my lawyer know and he added it to my claim. I requested a therapist due to all the stress and anxiety and depression. Once I brought this to his attention I asked him is there anything we can do ? And he brought up a QME. I’ve done one deposition so far but be let me know if I open “psych” that I would have to do another deposition. My biggest thing is, is it better to hold off for a QME? It took me a serious phone call about my mental health to get him to offer me a QME. I don’t think he would have brought up the QME idea if I didn’t sound more distraught. Not sure if that makes sense but any idea on what my case is worth ? If I did a stipulation or C&R? I’ve been offered 40k to settle but my lawyer said it’s way too soon I may or may not need more future medial or surgery. My right shoulder imo lost a lot of range of motion and gets really tight to move. During my physical therapy I do get pain with weight added. A little lost and distraught, anything that can help my case ? Work restrictions are nothing over 5lbs over my head and lifting no more than 10lbs (this means using BOTH arms). My work doesn’t want me back I believe it’s due to being liable ? However I am being compensated with workers comp.
