Student visa refused (genuine student criterion) — ART review pending almost 1 year while trying to pursue a PhD. Anyone in a similar situation?

Background
I'm an international student from South America. I've been in Australia since mid-2022, initially on a student visa. Last year I applied for a new student visa (subclass 500, VET sector) and was refused in May 2025 under the genuine student criterion (clause 500.212). My partner was included as a secondary applicant and was refused as a consequence.
The main reasons cited were lack of evidence of financial ties to my home country and that the course I was applying for was of a lower educational level than my existing postgraduate qualification. We lodged an ART merits review in June 2025 — almost a year ago now — and still no hearing date has been set.
The complication
Since the refusal, my situation has changed significantly. I am now in advanced discussions for a PhD at a major Australian research hospital, with a committed supervisory team at a Go8 university. The PhD is well above my existing postgraduate level — which directly addresses the progression concern the delegate raised.
I've updated my migration agent with this development and we've submitted the PhD correspondence to the ART as new evidence. But the core problem remains: I cannot lodge a new student visa while the review is in progress, and I've found that some universities have clauses in their HDR admission procedures that allow them to withdraw offers if an applicant has not been identified as a Genuine Student by Home Affairs.
What I'm looking for
Has anyone been through an ART review for a genuine student refusal and come out the other side successfully — particularly where circumstances changed significantly between the original application and the hearing?
Has anyone navigated a PhD application or admission process while an ART review was pending? How did the university handle it?
Any sense of current ART wait times for student visa cases? Almost 12 months and nothing yet.
