I recently got a job for a company in Georgia to sell their products. I am commission only.

The owner sent me the company agreement which stated I will be a W-2 employee. I told him the job posting said 1099. He said he can make me 1099 but I shouldn't tell the other employees. I told him to send me the 1099 agreement and have the terms and condition clearly state I'm an independent contractor. He changed his mind again and said he can't make me 1099 while others are W-2 so I'll have to be W-2.

I said that's fine. On the first day of work, he gave me a company agreement to sign which stated I'll be W-2. Then he gave me a W-9 form. I told him since I'm W-2, I'm supposed to get a W-4 and I-9 form. He said I would get those in an email from the IRS.

Obviously, that's a lie. I've started looking for a new job. I'm wondering what to do. Do I also report this to the Georgia Department of Labor or the IRS or contact an employment lawyer?
