Hi, I need some guidance regarding a family property issue in Bangalore.
My father owned a house (still in his name, no partition done yet). He has passed away, and the legal heirs are me and my 3 half-brothers.
The house currently has:
Ground floor + first floor (built by my father)
A third floor built by my eldest half-brother after my father passed
Now, my middle half-brother is saying he will:
Take 2 specific rooms (one on ground + one directly above on first floor)
Build an extension in the front area
He mentioned he may start construction in the next 15 days
I have NOT agreed to this, and the property is still undivided.
I spoke to a lawyer who suggested filing a complaint with BBMP if construction starts (unauthorized construction in disputed property).
My concerns:
Can he legally take specific rooms or build like this without partition?
Is BBMP complaint enough to stop this, or should I file for injunction immediately?
What’s the fastest and most cost-effective way to stop construction before it starts?
Has anyone dealt with a similar situation — what worked for you?
I’m also planning to move out soon, so I want to make sure my share is protected and no one takes control of the ground floor in my absence.
