Hi, my attorney filed a 132a against my employer.

My understanding is that I can get up to 10,000 (minus attorney percentage which is higher than our usual 15%). Does this also potentially cover wage loss?

Also, does this also potentially add additional value to my final settlement?

I don’t want to share details about my case here, but I would love it if a CA attorney or adjuster would explain it to me as if I was 5. I also would like to know what to expect down the road. I imagine I might be deposed again.

I’m disabled and I rely on food delivery to eat. I need my food delivery brought to my apartment door. It is not physically possible for me to bring it up from the lobby of my building. My instructions are detailed and I tip well. We also have an elevator.

Once again, my groceries are left in the lobby and I’m without food. I don’t know my neighbors well enough nor would I ask them to bring up my groceries. Last time my landlord was upset about all the rotting food left in the lobby.

Why does Amazon refuse to understand that a full refund, which usually takes up to an hour over chat to get, doesn’t solve the problem?

Great, now I need to email my landlord about rotting food in the lobby again. I’ll probably be charged a fee.

I had a my second QME related to my TBI recently. I have multiple symptoms; chronic headaches/migraines, vertigo, light sensitivity, hyperacusis, cognitive issues, double vision, speech impairments, etc

The neurology QME only rated my headaches and said I could work with no restrictions. He did add that I should get a QME from ENT, psychiatry and ophthalmology.

Will my TTD payments stop? My vertigo is severe and I’m a fall risk. I also can’t ethically go back to my previous work knowing that I have so many cognitive issues. I also can’t tolerate loud environments.

I don’t understand why he only rated my headaches. I have reports from multiple neurologists as well as PT, OT and SLP regarding my other issues

I will be talking to my lawyer next week.

Also, can the headache rating be challenged? He only discussed it with me for 3 minutes. Currently, with Botox I have improved with only occasional headaches, but that is only for the 8 out of 12 weeks that the Botox works. It wears off fast. I was marked at 3% since it’s occasional, but the reality is that 33% of the time it’s daily.

What can I expect now? What are good questions to ask my attorney? How can I avoid by TTD stopping? I should have 8 months left as long as I’m not MMI or released to work
