Partner Leave and Re-enter Spain EU (90/180 day overstay) whilst Family Residency Visa (pareja de hecho) is in process
Hello, my partner (Australian) has relocated to Spain to live with me (Spanish national). We have recently civil-registered our relationship in Barcelona (pareja de hecho) as I have nationality here and
applied for residency under Spain Family Reunification Visa. We are awaiting a resolution but it will be 3-4 months away. My partner has a really urgent matter with his work in the UK in June. He has currently overstayed his 90/180 days here in Spain, we are exercising his right to stay until the resolution of his residency. If he is to leave to the UK would he be able to re-enter Spain ? We are aware it is not usually advised but If I am to travel with him in this case as his EU partner can we exercise any rights there to re-enter Spain ? In regards to free movement etc .OR show proof of our family residency application. We would bring a copy of our apostilled documents. We are looking for any possible way he can re-enter Spain.
