I, (36M), have had my property rented to a tenant for the last 14 years. The tenants haven’t been difficult previously so I decided to be lenient on them by keeping the rent low, not penalising them for painting walls / doors without consent, etc.

I’ve recently been looking to either sell the house or move in myself. I struggled to evict last year due to insufficient paperwork so I kindly asked the tenants to leave themselves by a certain date so that I can potentially move in or sell the house (I tried selling with tenants but all potential buyers wanted the house to be without tenants). Eventually, there was on offer on the property on the condition that the tenants are evicted. I would’ve thought that after being a lenient landlord, that they would accept this offer of leaving the property by a set date but I couldn’t be more wrong. They of-course wanted an eviction for council property even though there’s properties now available within their budget, albeit a flat but that’s still larger than they need. Typical 🤦‍♂️. So I had to cancel the sale which costed me a bit of money which I should’ve had the tenants gone before accepting this offer but lesson learned (my mistake).

I decided to increase the rent slightly after more than a decade of low rent (still less than market value). But they weren’t too happy and have now decided to cut all contact except via email, they are complaining about petty issues and non-issues but I’ve been proactive in fixing these problems to avoid legal issues. I’ve informed them that I’ll be keeping them in the property for a few years now. But they aren’t happy with this and are begging me for an eviction. I have messages, recorded phone calls, and multiple emails that explain that they are willing to even pay the solicitors fees to get evicted. This doesn’t really sit well with me if I’m honest and after the pain they’re putting me through, I surely can’t let them get away with this deception.

If I informed the council regarding the above, would the council consider them to have made themselves voluntarily homeless?

Is there an easy way to have them evicted now that the new renters rights act is coming into force soon?

I’m not sure exactly what I’m looking for but any advice would help.
