My friend is leaving Deloitte, and he was shown documents when he was hired saying that her 401k would gradually vest over three years. He is being told now that it vests 100% at a three year cliff and will be revoked now when he rolls the 401k. Does he have any legal recourse here, or are there places where the historic vesting schedule is described? Unfortunately he did not save the benefits documents he was shown when he took the offer, and the contract itself is vague about how fast vesting occurs over those three years.
