How to File FDUTPA and OMMU complaints for misleading or deceptive promo changes

Sharing this because there has been growing confusion around recent dispensary promotional changes in Florida, especially QR-code based discounts where redemption terms appear to be changing after distribution.

This is not legal advice, just a straightforward guide for anyone who wants to formally document concerns with state regulators.

If you experienced something like:

A promo distributed via QR code or digital link

No stated requirement for physical card presentation at redemption

Later introduction of new conditions such as card must be present or additional restrictions

Terms changing after you already engaged with the promotion or submitted personal information

You may have grounds to file complaints under consumer protection and medical cannabis oversight channels.

FDUTPA Complaint (Florida Deceptive and Unfair Trade Practices Act)

FDUTPA covers misleading advertising and post-distribution changes to materially important terms.

File here:

https://www.myfloridalegal.com (Consumer Protection Division)

What to include:

Dispensary or company name

Dates of the promotion

How the promotion was originally presented (QR code, email, signage, etc.)

Original terms as shown at the time (screenshots if available)

What changed afterward (new restrictions or requirements)

How you relied on the promotion (submitted info, attempted redemption, visits, etc.)

Any denial or inconsistency at point of use

Helpful wording:

The promotional offer was distributed without disclosure of a physical card requirement or similar restriction. After consumer reliance, additional conditions were introduced that materially altered the original terms of the offer.

OMMU Complaint (Florida Medical Marijuana Program)

The Florida Office of Medical Marijuana Use also tracks dispensary conduct and patient-facing compliance issues.

Info portal:

https://knowthefactsmmj.com

What they care about:

patient communication consistency

promotional compliance

dispensary transparency

access issues tied to advertised offers

What to include:

same timeline as FDUTPA complaint

explanation of original terms versus later changes

emphasis on patient-facing inconsistency and lack of clarity

What strengthens complaints:

Screenshots of QR codes, emails, or promotional materials

Original FAQ or terms if available

Support chat or email responses

Proof of attempted redemption under original understanding

Why this matters:

These complaints are most effective when multiple patients independently report:

post-distribution changes to promotional conditions

unclear or shifting redemption requirements

inconsistency between advertised and enforced terms

FDUTPA Complaint Template (Florida Attorney General)

Copy and paste, then fill in brackets:

Subject: Complaint regarding misleading promotional terms

I am submitting a complaint under the Florida Deceptive and Unfair Trade Practices Act (FDUTPA) regarding a promotional offer issued by [DISPENSARY NAME].

On [DATE], I received or accessed a promotional offer distributed via [QR code / email / in-store card / website]. The offer was presented as [DESCRIBE ORIGINAL OFFER BRIEFLY, e.g. “a $25 discount code with no stated minimum spend or physical card requirement”].

At the time the promotion was accessed, the terms did not state that a physical card must be presented at redemption, nor did it indicate any additional restrictions beyond what was displayed at the point of distribution.

After I had already engaged with the promotion and/or provided personal information, I was informed that additional redemption conditions applied, specifically: [DESCRIBE NEW CONDITION, e.g. “physical card must be presented”].

This change materially altered the original terms of the promotion after consumer reliance.

As a result, I believe this may constitute a deceptive or unfair trade practice under FDUTPA.

Subject: Patient complaint regarding promotional consistency and redemption terms

I am submitting a complaint regarding a patient-facing promotional offer issued by [DISPENSARY NAME], which appears to have changed materially after distribution.

On [DATE], I accessed a promotional offer via [QR CODE / EMAIL / IN-STORE MATERIAL]. The promotion was presented without any requirement for a physical card at redemption and included the following stated terms: [SUMMARIZE ORIGINAL TERMS].

After engaging with the promotion and/or providing personal information, I was later informed of additional redemption requirements, specifically: [DESCRIBE NEW REQUIREMENT].

These conditions were not disclosed at the time the promotion was distributed and may create inconsistency in patient-facing communication and access to advertised benefits.

Details:

Original promotion: [SUMMARY]

Changed requirement: [SUMMARY]

How you were impacted: [DENIED / CONFUSION / ADDITIONAL STEPS REQUIRED]

Hope this is helpful for some patients affected by these types of deceptive practices.

UPDATE 2: Response from The Flowery

I received this update shortly after sending over the patient summary and letter. Thanks again for all your help.

Follow-up to The Flowerys $25 QR code

I’ve compiled the information shared yesterday in the thread into a formal written complaint summary, and submitted it directly to The Flowery via email for review.

The document outlines the reported inconsistencies in how the credit is being applied, requests clarification on the official terms as they were presented at signup and thereafter, and includes questions about account handling and personal identifying data collected during enrollment.

If there’s any response or clarification provided, or no response at all, I’ll share another update here.

Thanks again for your help.

EDIT: RESPONSE RECEIVED. PLEASE SEE UPDATE 2

Didn't get your $25? Comment below

Hi flmedtrees,

I wanted to jump in on an issue that appears to be affecting multiple people here.

A promotional business card with a QR code was circulated offering a $25 credit in exchange for providing personal information and signing up for the dispensary email list.

Users scanned the QR, completed signup, and received the credit added to their accounts.

However, when attempting to redeem, many are now being told there is a $125 minimum purchase requirement, which was not disclosed on the card or signup page at the time of enrollment.

Customer support responses are indicating the terms were “updated recently” and referencing standard language about promotions being modified at any time.

There was no minimum purchase by customer services own admission. The credit appears valid in account, but redemption is blocked under new condition. Customer support states management is applying updated restriction retroactively.

If you were part of this promo and have:

screenshots of or the actual QR promo card

Screenshots of the original signup page

confirmation of your account credit

or support responses indicating they will not honor, it may help establish a clear record of how the promotion was presented at time of opt-in.

Not sure what's next, maybe a FDUTPA complaint, but for now, just trying to confirm scope and consistency of what people were shown vs what’s being enforced. Please comment below or dm. Thank you.
