I recieved an email from the Germany team. They pretty much said they allow one appeal per 45 days and this case appeal was rejected and closed and they won't review anything further.

They didn't explain whether they believe package was tampered with or how they arrived at their decision.

Furthermore after speaking with lawyers online... I was told even if you win at court collections against a big Corp like them will take years, one lawyer pretty much said I should pay ebay the fees they have charged me and move on as it would be costly uphill battle.

Additionally they just added ... a halt on account and did an IP ban on me ( you can no longer have a new account )

And all my sales are halted ...

They also informed me they will be withdrawing the 3200$ on the 30th ... I had to do everything with my bank I possibly can to block this for now ...

I have an appointment with a lawyer today.... but I'm already feeling defeated

Hi everyone, I’d really appreciate some guidance on a cross-border dispute involving eBay and a high-value transaction.

I’m a Canadian resident and recently sold approximately C$15,500 worth of 1oz American Eagle silver coins to a buyer in Germany via eBay. I shipped the item using FedEx International Economy with full tracking and direct signature required. I also documented the entire process thoroughly — including video of packaging, proof of ownership, and drop-off receipt.

Tracking confirms the following:

- The package cleared German customs

- It was delivered on April 14 to the buyer’s residential address

- Delivery was marked “Delivered to Residence” with signature required

After delivery, the buyer opened a claim stating the item did not match the description (alleging they received something else " a bag containing miscellaneous coins " instead of the silver ). They also mentioned opening the package at customs, which appears inconsistent with the delivery record.

I accepted a return in good faith and even provided a prepaid return label. However, the case escalated, and eBay ruled in the buyer’s favor and refunded approximately C$15,750 before he even shippen anything back on a INAD cade. My appeal was denied despite submitting an appeal:

- Delivery confirmation with signature requirement

- Packaging video evidence ( screenshots of it as ebay doesn't allow large files )

- Shipping receipt and proof of ownership

eBay has indicated that their German team handled the case and that the decision is final.

At this point, I’m exploring next steps and would appreciate input on:

  1. Whether there is a viable legal claim (against the buyer and/or potentially eBay) given the confirmed delivery and evidence

  2. Jurisdiction considerations (Canada vs Germany vs eBay’s terms of service)

  3. Whether a lawyer demand letter to eBay is worthwhile before proceeding further

  4. The practicality and enforceability of pursuing small claims or civil action in this type of cross-border scenario

Any guidance on the most cost-effective and realistic path forward would be greatly appreciated.

Update : contacted eBay ( requested a call back ) the lady on the phone was very nice, however she explained that this case was handled by ebay team in Germany, so she's sending a request to them to contact me but they will contact me via email only ! I'm truly terrified of this process and the stress is driving me insane... I'm out of so much silver and also now on ebay owe them 3k in fees!

Also the most ridiculous of it all is that my return label wasn't even used. Nothing was delivered back! Ebay ruled against me before it was even used and even rejected my appeal.

This was my first high-value sale on eBay (~C$15,500 worth of 1oz .999 silver American Eagle coins). Because of the value, I took every precaution possible.

I recorded a full packaging video showing the coins being packed, sealed, and prepared for shipment. I also have photos/videos from drop-off and the FedEx receipt. The shipment was sent via FedEx International Economy with direct signature required.

Tracking shows:

- Cleared customs in Germany

- Delivered on April 14

- Marked as “Delivered to residence”

- Signature required service was applied

After delivery, the buyer claimed that the package did not contain the silver coins but only two bags if miscellaneous coins and mentioned something about opening it at customs. This contradicts the tracking, which shows final delivery to a residence, not customs.

The buyer opened a return request, which I approved in good faith. I even purchased and sent them a return shipping label.

Despite all of this, the case escalated and eBay ruled in the buyer’s favor under “item not received,” and refunded them C$15,750 (including shipping), which was deducted from my account.

I appealed the case and provided:

- Packaging video

- Proof of ownership (original purchase receipt for the silver)

- FedEx drop-off proof

- Tracking showing delivered to residence with signature requirement

eBay still denied the appeal and upheld the decision.

So now I’m in a situation where:

- Tracking confirms delivery

- Signature was required

- I have full documentation of the item and shipment

- But eBay still sided with the buyer

I’m trying to understand:

  1. How does “item not as described” apply when tracking shows delivered with signature? And I have everything regarding packaging video and proof of the silver being legitimate)

  2. Has anyone successfully reversed something like this after appeal?

  3. Should I escalate with FedEx (signature/GPS proof), file a police report, or pursue chargeback/legal options?

I'm so lost someone help

Any guidance from experienced sellers would be seriously appreciated. This is a major loss and I genuinely feel like I did everything right.
