34F high school teacher in California with an accepted workers’ comp claim (DOI 11/7/25). Looking for strategy advice from people who’ve navigated CA WC while also having private insurance (Kaiser).
Injuries
• Right knee – high-grade (Grade 3/4) chondromalacia with persistent patellofemoral pain
• Left ankle – Grade 2 sprain with mechanical instability
• New issue: developing left knee pain likely from compensating gait
Current Status
• Claim accepted by Athens/CorVel
• Multiple treatment requests went through UR denials (PT extension, PRP, brace, specialist referral for knee)
• After my orthopedic surgeon pushed back, 12 additional PT sessions were just authorized
• WC ortho plans to re-request ankle brace + knee specialist; surgery mentioned only if(when) physical therapy fails
Private Insurance Situation
I also have Kaiser with excellent coverage ($10 copays).
I filed a grievance/continuity request because treatment delays have been affecting recovery. Member Services told me I can receive treatment through Kaiser using my health insurance (not billing WC).
I have a Kaiser PCP appointment Monday.
Questions
Attorney timing: When did you decide to hire a WC attorney in CA? Is repeated UR denial + delayed care usually the point people retain counsel?
Dual treatment: Is it acceptable to attend WC-authorized PT while also being evaluated/treated through Kaiser?
If Kaiser becomes primary: Does that end or weaken my WC claim, or does it mainly change who pays upfront?
Compensatory injury: Best way to document new knee pain so it isn’t later disputed as non-industrial?
Goal isn’t settlement unless that’s my only way…… I just want timely treatment and to get back to functioning normally in the classroom and daily life. I am a triathlete and mom and can’t do the most basic activities. I am in pain and just want treatment.
Appreciate any CA-specific experiences or advice.
