Terminated in 3 hours, company denying notice pay
I was put on PIP in December, a month after returning from my maternity leave, I cleared my PIP and have an email stating that I successfully cleared PIP and no longer on notice.
Then 2 months later HR calls me and tells me I am terminated due to performance issues and my access were revoked 3 hrs later. They are telling me that they are not obligated to give me notice or pay in lieu of notice as PIP was my notice. It has been 3 weeks since I submitted my assets, they have not even given me a relieving or experience letter yet.
The employment agreement that I signed mentions a written warning with a 30 day cure period that I was not provided. They are deeming 1:1 with my manager with no written document, as a warning.
As per my understanding, this termination is not legal and I am eligible for a 60 day notice pay. I have sent multiple mails to HR with no response.
Requesting legal advice on next steps and whether making a formal complaint with the labour commissioner is a valid option in my case.
