Mijn eenmanszaak heeft vandaag een sommatie ontvangen op basis van een inbreuk op auteursrecht.

Context:

• Het betreft een foto die vanaf Wikimedia Commons is vergaard onder een Creative Commons Attribution-ShareAlike 4.0 International licentie.
• De foto is gebruikt als achtergrondbeeld onderaan op de homepage van twee websites, vanaf 13-03-2026 tot en met vandaag.
• Er staat geen directe accreditatie bij de foto, alleen in de metadata. Dit was een fout vanaf mijn kant.
• De foto is vandaag direct van beide websites afgehaald.

De sommatie:

• De incassodienstverlener eist dat er binnen 5 dagen een schikking van rond de € 1.500 overgemaakt wordt.
• De volgende schadeposten zijn vermeld in de sommatie:
  • Misgelopen licentievergoeding 2 foto’s + homepagina € 1256,00
  • Inbreuk auteursrecht (art. 1 Aw) € 314,00
  • Inbreuk persoonlijkheidsrecht (art. 25 Aw) € 314,00
  • Juridische kosten (1019h Rv jo 6:162 Bw) € 234,03
  • Incassokosten € 317,70

Genomen uit de meest actuele plain-text variant van de CC A-SA 4.0 licentie:

>Section 6 -- Term and Termination.

a. This Public License applies for the term of the Copyright and
Similar Rights licensed here. However, if You fail to comply with
this Public License, then Your rights under this Public License
terminate automatically.

b. Where Your right to use the Licensed Material has terminated under

2. upon express reinstatement by the Licensor.

Geziene ik de eenmanszaak tot nu toe uit eigen inkomen drijvende houd, ben ik niet zomaar in staat om €2.500 op te hoesten.

Moet ik hierop reageren, en kom ik er niet omheen om een advocaat in te schakelen? Ik heb geen idee welke volgende stappen ik nu kan ondernemen.
