End of an uber trip, the driver stops at a pedestrian crossing for the passenger to get out. Not parked in a parking bay or taxi rank, just stopped on the road with slow moving traffic.

Passenger opens the curb side back door to exit.

E-scooter rider cuts down the curb side of the traffic stopped at the pedestrian crossing, and runs into the Uber’s open back door. Not a bike lane, just the space between the curb and the cars.

Ambulance is called by the uber passenger, venue security come out to assist, rider and their e-scooter are both ok.

Rider admits to having been drinking all afternoon.

Uber car seems ok, there’s no aesthetic damage to the car. The back door is clicking a bit when it opens and closes.

Uber passenger offers details to paramedics, who decline to take them down because it’s not a “road accident” and they don’t need them. Paramedics and venue security both tell uber passenger and driver it’s ok to leave.

The police aren’t dispatched.

If there’s any damage to the Uber, who is liable for it?
