I share a fence with a property owner who lives in North Carolina. Our shared fence needs to be replaced. It is brittle, warped, rotted, and falling over in several places After several discussions and propositions, my neighbor refuses to allow us to replace the fence between our properties.

I have offered to pay for the entire project and he still refuses i have chosen a tan vinyl fence. Apparently, our neighbor who doesnt live here says he doesnt trust vinyl as they fade and may fall over in heavy winds.

Our contractor came out and did a property line assessment and informed us that the fence is within our property line. By law, we do not need consent if the fence lies on our property. As good neighbors we let him know about the findings and told him we were going to proceed with the removal and replacement.

 We are at the point where he is threatening legal action against myself and the contractor. While I have read the statutes and his claims have no standing, we are hiring a site surveyor to confirm the fence is on our property line.
