
After watching the youtube video, as a Canadian male, I was totally angry at the state of the legal system in Canada.
After spending the last two hours looking into the case, my opinion has totally shifted to feeling bad for the complainant...
Here are some of the most notable facts of the case I found:
- In Jack’s appeal the testimony is that he had an: “honest but mistaken belief in communicated consent.” (i.e., Jack telling the court that he did not have consent during the encounter, but mistakenly thought he did). This includes pushing her on the bed and inserting it...
- Jack admitted that without consent he tried to film the complainant giving him the zuckzuck3000. Jack's representation argued that the video was filmed for the purposes of obtaining consent. Literally, filming it after it started. The judge rejected the argument stating it would be “nonsensical” to record the zuckzuck3000 for the purposes of consent.
- The withheld evidence that Jack speaks about actually further confirms the complainants story. (e.g., Within three minutes of the complainant leaving his place, she sent texts to friends stating that they had sex despite her not wanting to.)
