No charges for Gastonia police officers who shot, killed armed man at convenience store

Gastonia, NC - The deadly Gastonia police shooting of Derrick Terrell Manigault at a convenience store in January has been ruled justified by the Gaston County district attorney.
The district attorney’s office released a report this week detailing the events that led to the shooting death at Jakob’s Food Mart on Jan. 10, 2026. The report says it happened during an undercover investigation into alcohol sales involving minors, unrelated to the ABC enforcement operation.
A Gastonia police sergeant and a detective working undercover observed a dispute between two men in the parking lot, which then moved inside the store, according to the report.
The two men were identified as Manigault and David Sanders. The report says the detective observed Manigault threatening Sanders inside the store while holding what appeared to be a firearm. The detective opened fire at Manigault because of concerns that he might shoot Sanders and endanger the lives inside the store, the report says.
The gun Manigault was carrying was later determined to be an imitation weapon that was made to look realistic, but could not actually fire, according to the report.
Surveillance video shows Manigault running away from the store, prompting both undercover officers to fire additional rounds at him. Investigators say he fell on a sidewalk and was taken to a nearby hospital, where he was later pronounced dead.
Investigators used witness accounts and surveillance video from the scene to reach their conclusion that the shooting was justified and that no charges will be filed against the officers.
