Not all markets are the same

This is something people aren’t taking seriously enough:

Fines per violation, not per day:

Often $1,000 – $10,000 per violation per state

Some states add $1,000–$2,500+ per day of continued operation

So if you (marketplace) processed:

1,000 transactions → that’s 1,000 violations

That can quickly turn into:

$100,000s to millions in civil penalties

If a marketplace is holding or moving your money NFTs, services, real-world assets and doesn’t have a Money Transmitter Licenses (MTLs), you’re taking a real risk.

MTLs aren’t just paperwork. They’re what force platforms to follow rules around custody, fraud, and protecting users.

If they’re running escrow, holding balances, or sending funds on your behalf without being licensed, there’s usually no real oversight and not much you can do if something goes wrong.

Non-custodial platforms are different. But the second a platform starts acting like the middleman for your money, the rules change.
