I bought a Trailseeker off the lot almost two weeks ago. I still don’t have possession of it.
After I had signed on the dotted line, it was revealed through the dealership’s detailing procedure that there were cosmetic defects which apparently occurred in transit that they couldn’t correct. They offered me a loaner car while they attempted to correct the issues with their in-house collision center.
Due to difficulty in sourcing the parts needed for a full repaint of the car, I have since been the owner of a car I don’t have. I am promised to have the car delivered to me by next weekend. The problem with that is it won’t be a “new car” under applicable state law.
I have requested that the dealership go to bat for me with Subaru of America for compensation for loss of value. This is well established in my state’s case law as a cause of action. Buyers have typically been awarded punitive damages as well if they take their cases to court.
Has anyone had a similar experience?
