Say for example, John Smith is a short (abnormally small) fat Italian plumber whos hat has an M on the front center (his business logo) and he wears blue overalls and a red shirt/hat. John Smith decides he would like to make a video game depicting himself. Would Nintendo likely win a lawsuit for copyright? If they would, then wouldn't that mean Nintendo owns John Smiths image and likeness?
