Sellers did not disclose this, can i sue for cost of repair?

Location: Indiana

We have a brick foundation, and today it started storming for the first time since buying our house and moving in a week ago. I went into the basement because i heard what sounded like a waterfall and lo and behold one of the walls has water seeping/ pouring out of it in between the bricks and into the basement. I followed the flow of the water and found what looks to be like a makeshift diy french drain situation in the corner. Clearly they knew about the water since they made the drain and they also have a dehumidifier placed in that area of the basement.
They had some old windows and a door sitting on either side of the drain but not rendering it inaccessible, it was still visible if you simply glanced at the floor in that corner. The day the inspector came it was not raining so I know he wouldn't have a way of knowing about the water coming in, but he definitely could have seen the makeshift drain in the corner and it was not on our inspection report at all.

Is there anything that can be done legally since the seller failed to disclose?

can I ask for a partial or full refund from the inspector?

buying a house and inspector noted this crack. the foundation is brick, this photo is taken in the basement. this wall is one of the only walls with parge coating on it, the rest are exposed brick. there is no bowing, or other signs of the structural integrity being compromised. is it safe to assume that the crack is due to water damage, and solely cosmetic, due to the visible water damage on the window sill and the crack starting directly below it?

my game plan for now is to monitor the crack to watch for spreading to intervene sooner rather than later if i do see it worsen. just wanting to see some opinions on here because it just isn’t one of the top priorities due to a couple of other costly things needing done more urgently.
