Real estate after death

So my mother in law had a ladybird deed that provides her condo goes to my husband and his brother, but it was not recorded before she died. Now they have a buyer and a lawyer is telling us we have to go through probate because it wasn’t recorded.
I’m a lawyer in MN, where she lived as well, so the probate wouldn’t even be in Florida. Here a transfer on death type deed is valid even without recording it prior to death, so I’m not sure I believe him.
Can’t we just send the ladybird deed to the county office with the fee and get it recorded now?
