boolean problem with cartoon eyelid rig

i've used boolean to make a eyelid style of rig kinda like the one in TADC were instead of the eyelid rotating back it kinda carves itself out untill it dissapears, but for some reason this rig in particular has the problem were the boolean cube i used to carve out the eyelid keeps glitching and appearing out of nowere, i can't do animations cuz it sadly appears in rendered stuff too, anybody has some clue of what i can do to fix this? also it's not just a blender 2.7 problem, 4.0 has this problem too
