How often do you see your VA provider for treatment to show continuity of care to protect your rating? Weekly, monthly, quarterly?

I’m trying to stick with the same doctor but new rotation in the mental health clinic sometimes doesn’t allow it. It’s exhausting having to start from square one with a new stranger and revisit very sensitive topics. Sometimes I just want to say f it and stick with just medication but it worries me about the false perception someone up in the rating department may assume due to lack of treatment sessions.

Carshield Spam Out of Control

No matter how many times I flag and block these emails, they continue to get through. The amount of spam this company sends and gets through is ridiculous and Gmail doesn’t seem to get a handle on it. I’ll try a filter next.

Claims deferred for review by same examiner

The VA has deferred some of my claims for further review at the same location the C&P exams were conducted. The problem, after seeing the DBQs and medical opinion, the examiner claimed none of my issues were service connected with contradictions and inconsistencies ignoring a lot of the workup done at the VA showing continuity of care (something she said I lacked). The other issue she stated was I didn’t address some of the issues at my separation exam or within a year of separation and according to some research, this shouldn’t be something that slams the brakes on conditions that gradually deteriorate over time.

Optum Serve site shows upcoming exam and it’s in there for review but it says my presence is not required for this appointment. My concern is that the notes in there are missing key pieces and ignoring onset while on active duty.

***How can I get ahead of this and prevent this faulty exam from leading to a denial?*** It has the same name of medical facility and address where I was seen which I imagine will be the same person who submitted these opinions. Clearly the VA saw some issues for them to ask for rework and deferring their decision, but they also just denied me on one major claim based on the same examiner’s opinion. If the exam notes and opinion had issues, then why not just kick it all back.

My back injury claim that severely impacts my daily life was denied based on this erroneous exam/opinion and it’s one of the conditions I have the most documentation and exams. I’m still being treated with ongoing appointments. Blows my mind how with the onset and treatments while on active duty and voluminous file of post-service treatments got denied. I’m already working on the supplemental claim to kick it back to them but I’m worried about this person doubling down on their faulty exam notes.

Supplemental Claim Nexus Letter

According to ChatGPT, I should include a nexus letter on my supplemental claim to contest the flawed DBQ and medical opinion that resulted in a denial. Even with a Scheduled-A letter I managed to get while participating in CWT program stating mental and physical limitations.

Problem is all my medical visits are at the VA and from what others have said, none want to go out of their way to provide a nexus letter. I haven’t directly asked my pain management or PCP but I’m pretty sure they may be reluctant to do that which is unfortunate because they know far more than anyone else the struggle and pain I deal with along with failed treatments.

What am I left with, an outside physician who hasn’t seen me before? I can provide some exam results with impressions along with the numerous treatments provided by the VA. Is that enough? One doctor wants to charge me $500 I believe. What’s the best way to navigate this while avoiding the nexus letter mills which would flag my file?

My rating increased by a measly 10%

After fighting with them and appealing for years. The examiner really screwed me by stating not seeing service connection and lack of post service medical work up (lies) and the VA had requested rework on some of these DBQs and opinions from what I can tell in the file names. I was about to submit a FOIA (still am) to see what these new DBQs reworked stated but seems like the VA has already made their decision. It says I have a letter ready but I can’t seem to find it. Where should I be looking? I’m pissed. This was an appealed that was kicked back down by the judge and now it seems like I have to kick this up to the Board once again.
