Aetna agreed to a $1.75M settlement for denying infertility coverage to LGBTQ+ members in California

Aetna settled a California class action for denying equal infertility coverage to LGBTQ+ members. Default payout is $10,000 per eligible person, plus a separate $1,408 Dollars for Benefits payment.

Who qualifies

All four must apply:

California resident on an Aetna plan with infertility benefits between April 17, 2019 and December 31, 2024Had a uterus during that periodWas in an Eligible LGBTQ+ RelationshipWas denied IUI or ICI coverage, or paid out of pocket believing you were ineligible

Do you need proof?

Depends on your category (listed on the notice Aetna mailed):

Category A: No proof. No form needed. The $10,000 is paid automatically.Category B: No receipts. Just an attestation that you were in an Eligible LGBTQ+ Relationship.Category C and D: Attestation plus evidence of out-of-pocket IUI or ICI expenses.

For the Special Harms Fund ($250,000 separate pool), you submit details of extraordinary harms: extra costs, pain and suffering, delays in getting pregnant.
