I had an examiner interview where the examiner basically said “you didn’t have X in the working examples…therefore your claim is like a CIP because you never claimed X before.” None of this was based on actual fact so we were like huh?! So my question is…what are your favorite 112 arguments that work well with an Examiner that is stuck on one example of your spec showing an opposite thing from what you are claiming but you still have support for the claimed embodiment?!

This question is more for our life science patent practitioners/PCT experts.

Has anyone successfully got their international filing date back by responding to the Notification Concerning Later Filed Sheets? We had a sequence listing submitted too soon in response to an invitation to correct defects.

My understanding is that responding to the new Notification rescinding that sequence listing will move the international filing date back to the original date. Do you have to file anything with that response to get your original filing date back?

Open to discussion/ideas. What worked for you here?
