Pause on Derivative of I-140

I will be filing for an I-140 and wondering if there are any unique cases like mine.

Primary applicant from non-ban country.

Derivative (spouse) citizenship from ban country but ‘country of birth’ from non-ban country.

Note: I-140 only requires to fill ‘country of birth’ for derivative and not citizenship.

Wondering if my case will be on pause.

Any other option like not including derivatives in I-140 but include them later during AOS or Consular Processing?

Any I-140 approvals where the derivative spouse is from one of the 19-country ban countries, but the primary applicant is not?

Hi everyone,

I wanted to check if anyone here has had an I-140 approved where the primary applicant is from a non-ban country, BUT the derivative spouse is from one of the 19 countries on the ban list.

I am trying to understand whether the derivative’s nationality caused any issues at the I-140 stage, such as delays, extra scrutiny, or any kind of hold, even though the primary applicant was from a country not on the list.

If anyone has had a similar experience, I would really appreciate hearing:

- whether the I-140 was approved

- whether there were any pause, delays or unusual issues

- whether the concern came up only later at the visa/AOS stage instead of the I-140 stage
