Hi everyone,

I’m currently working on STEM OPT as a full-time employee with my current employer. They’re not able to sponsor or fund any visa (H-1B or O-1), and they’ve also made it clear that they don’t want to convert my role into a contract position now or in the future.

I’m considering going through a USA agent-based O-1 filing on my own.

My main question is:

If I get my O-1 approved through an agent, can I continue working with my current employer in the same full-time capacity without interruption?

Ideally, I want to:

  • Keep working with the same employer
  • Continue in a full-time role (not contract)
  • Not require them to sponsor or pay for the visa

I’m trying to understand:

  • Whether this is legally possible
  • If the employer needs to be included in the O-1 petition as a client/worksite
  • Whether I can remain a true full-time employee (W-2), given they won’t support contract conversion

If anyone has gone through a similar situation or has experience with agent-based O-1 setups, I’d really appreciate your insights.

I’m currently on STEM OPT (final year) with about ~8 months left, and I’m trying to realistically evaluate my chances for an O-1 visa and whether my timeline is enough.

Here’s my situation:

  • Working in the data/public health/NGO space in the U.S.
  • Current compensation is 6 figures (~$110k) in the nonprofit sector
  • I do have an H-1B filed through another employer, but I’m not very optimistic about it, so I’m seriously considering O-1 as my primary path

My profile:

  • Strong involvement with NGOs in the U.S. with measurable impact
  • Media visibility (articles/interviews published about my work)
  • Around 5 solid recommendation letters, including CEO-level and senior leadership
  • Documented real-world impact (projects, automation, cost savings, reporting improvements, etc.)
  • Portfolio with detailed evidence of my work, contributions, and recognition

My questions:

  1. Based on similar cases, does this profile sound competitive for O-1 (not just borderline)?
  2. Is ~8 months enough time to prepare and file an O-1 and get approval (with premium processing)?
  3. Has anyone here successfully transitioned from F-1 STEM OPT → O-1 without a gap?
  4. Would you recommend going through:
    • Direct employer sponsorship
    • Or agent-based O-1 for more flexibility?
  5. Any red flags I should watch out for before starting the process?

I’m planning to start working with a lawyer ASAP, but wanted to get some real-world insights from people who’ve gone through this.
