Last year the toilet in our apartment backed up and flooded our apartment with (mostly) clean water. The landlord decided that our insurance was responsible for covering the repair costs, despite not making it clear. We finally heard back from the insurer (SquareOne, if it makes a difference) last week and they agreed to cover 70% of the costs, with the remaining 30% being considered a "depreciation rate". Our landlord conceded that this is a standard outcome, but claims we are responsible for covering the remaining 30% out of pocket. Is this really the case?
