Unsure of Wage Theft (??)
Hello! I wanted to post on here because I’m unsure of a few things. For some background, as an employee there is no contract, just terms and conditions on the initial offer letter sent to me in 2022. This is an “At Will Employment” company and is fully remote, company based in California. My questions falls along the lines of overtime. I was always told I could not be paid for overtime and my time card was adjusted to be exactly 40 hours a week. I would stay within the 40 hours since it was clearly mentioned to me by my supervisor at the time but sometimes I’d go over a bit and it would be adjusted.
However, there has been a change in leadership and my new supervisor of the last 6 months has let me know that I can do overtime and that I should be paid for the extra time I put in. As a result, I’ve been putting in 30 minutes here or an hour there. Nothing crazy, just enough to work my work done for the day.
On Friday, I had a lot of work back logged and took some extra time to get it all done and clocked out as usual. I need to go in and cancel some PTO I had submitted and checked my time card randomly and noticed the time was altered. It was changed to 4:37, even though it was closer to 5:15-5:30ish? Nothing crazy and not something I hadn’t done before. Although it’s not a ton of time, my concern is that this has been done before without my knowledge.
I emailed HR to check on the terms and conditions to see if there was a cap on overtime and this is in my offer letter:
“Your position will be eligible for overtime for hours worked over 40 hours a week or 8
hours in a day, at time and one-half, in a normal workweek, and; double time rate (2x hourly rate) for all hours worked in excess 12
hours in any workday.”
I’m unsure if this is anything and don’t want to bring it up to my supervisor if it’s just something that is done at a program level. I’ve asked HR to confirm this on their end as well but wanted to see if anyone had a similar situation and how it went.
