Hello all,
I'm filling out my TRV form and am stuck on the question "Have you ever committed, been arrested for, been charged with or convicted of any criminal offence?"
Here's my situation -
My ex-wife was with me in Canada after which she left for our home country to record an FIR and I need to travel back to meet with the Investigating Officer to record my statement.
There's no chargesheet, the matter is not in court, no arrest warrants, no convictions, nothing.
From what I understand, an FIR is just the start of an investigation and not the same as being formally “charged” (especially from a Canadian/legal interpretation standpoint).
That said, IRCC wording is broad, and I don’t want to risk misrepresentation.
My current thinking:
Answer “Yes” and briefly disclose it as:
>
But part of me feels like this might be over-disclosure since technically I haven’t been “charged.”
Wondering what you'd do in my shoes?
