Hey everyone, looking for some guidance here.
My wife’s younger sister is from Brazil and came to the U.S. on a tourist visa when she was around 12 years old. She ended up staying past the allowed time and didn’t leave until she was about 14.
Now she’s 16 and wants to come back to visit again. The visa in her passport hasn’t expired yet, but we’re not sure if it’s still valid because of the overstay.
I’ve read that unlawful presence might not count the same for minors, but I’ve also seen that overstaying can void a visa automatically.
Does anyone know:
Is she able to travel on that same visa?
Or does she need to apply for a brand new one?
